Winning a judgment against another business is a big step. It doesn’t mean you’ve been paid. Many judgment creditors find that the debtor moves money, changes entities, or simply ignores the judgment, and collecting $100,000 or more takes more legal work and more cost.
Darkwell Capital helps businesses fund the work of collecting judgments they’ve already won. Our commercial funding, including collection of business judgments, focuses on claims of $100,000 or more, subject to review and approval by our team.
Quick note: Darkwell funds legal claims. We’re not a law firm and this isn’t legal advice. Talk with a licensed attorney in your state about your claim and your deadlines.

How judgments get collected
- Finding assets. Post-judgment discovery and debtor examinations to locate bank accounts, receivables, real estate, and equipment.
- Enforcement tools. Judgment liens on real property, garnishment of bank accounts or receivables, and levies on other assets. Available tools and procedures vary by state.
- Transfers and new entities. If the debtor moved assets to insiders or a new company, state voidable or fraudulent transfer laws may allow those transfers to be challenged.
- Other states. If the debtor’s assets are in another state, the judgment may need to be registered or domesticated there first.

Don’t let the clock run
Judgments don’t last forever. States set how long a judgment and its liens remain enforceable and how to renew them. Assets can also disappear while a creditor waits. Ask your attorney about your judgment’s deadlines now.

Why collection stalls
Collection is billed like litigation: by the hour, and results are never certain. Lawyers who handle contract matters bill an average of $373 an hour, according to Clio’s Legal Trends data (2025 figures). After paying to win, many businesses hesitate to spend more to collect.
How Darkwell helps
Litigation costs are substantial, and they land on your business while it’s still waiting to be paid. Darkwell helps carry them. Darkwell funds the collection effort. You keep your judgment, and your attorney runs the collection.
- We help carry the cost. Darkwell funding helps pay for the case, so your operating cash stays in your business.
- We bring attorneys we know. Darkwell has a network of attorneys we know. They help keep costs down while still pursuing the claim. The claim moves forward with an attorney from our network, or your current attorney where it fits.
- Your attorney handles the law. We don’t run your case or choose your legal strategy. Your attorney does that.
- You make a clear decision. The goal is to take the stress out of the fight and make the smart financial decision about your claim.
What to send for a claim review
- The judgment, and the court and case number.
- What you know about the debtor’s assets, bank accounts, customers, and related companies.
- Any collection steps already taken.
- Key emails and letters, especially anything where the other side admits or disputes what it owes.
- The other side’s full legal name and state, and anything you know about its assets or insurance.
- Your attorney’s name, if you already have one.
