How to Fund Judgment Collection With an Attorney

You already have a judgment — or you are about to — and the hard part is no longer “winning on paper.” It is collecting. Bank levies, debtor exams, asset searches, and post-judgment motion practice cost money. When the judgment debtor stalls and your attorney’s retainer is the bottleneck, that is a capital problem, not a legal-strategy problem.

Short version: a judgment is not cash. Collection takes work. Some judgment creditors fund that work with litigation finance or sell eligible claims so counsel can keep moving without the client floating every fee.

Why judgments stall after “winning”

Common patterns (educational, not a diagnosis of your file):

  • The debtor has assets but will not pay without pressure.
  • The debtor looks judgment-proof on the surface, but counsel has not yet run a full collection plan.
  • You cannot afford the next round of discovery, exams, or enforcement filings.
  • Multiple jurisdictions or related entities make tracing expensive.

A blog cannot tell you whether your judgment is collectible. An attorney who practices judgment enforcement in the right state can.

What “fund judgment collection” usually means in practice

At a high level, capital conversations for judgment files often look like one of these (labels vary; none is automatic):

  1. Fee / cost funding — capital toward attorney fees and out-of-pocket collection costs so enforcement can continue.
  2. Claim purchase / assignment — in eligible cases, purchasing rights in the judgment or claim so the creditor gets liquidity and the buyer takes collection risk (subject to documents and law).
  3. Hybrid structures — sometimes both elements appear; terms are file-specific.

What underwriters typically want to see

Useful review packets often include:

  • The judgment (or near-final judgment posture) and case caption
  • Amount still unpaid (principal, interest concepts as reflected in the judgment)

  • Counsel already involved (or readiness to retain counsel)
  • Prior collection steps taken and results
  • Any bankruptcy, appeal, or stay issues you know about

Missing pieces slow a review; incomplete ghost stories usually are not fundable.

National framing — state law controls

Judgment collection is state- and fact-specific. Exemptions, wage garnishment rules, homestead concepts, and timelines differ. When capital is the real blocker

Capital may matter when:

  • Liability / judgment posture looks strong on paper, and
  • Collectability is plausible enough for counsel to recommend next steps, and
  • The reason enforcement paused is cost, not “there is nothing left to try.”

Capital does not fix a worthless paper judgment, a discharged debt in bankruptcy (when applicable), or a strategy vacuum. Funding is not a substitute for counsel.
