When a customer won’t pay, it’s tempting to pad the lien: add disputed extras, interest you haven’t earned, or work that isn’t done yet. In Colorado that can backfire badly.
This page explains the excessive lien rule, the groundless-document rule, and the spurious lien process, and how a clean, well-documented claim is easier to fund.
Quick note: Darkwell funds legal claims. We’re not a law firm and this isn’t legal advice. Talk with a licensed attorney in your state about your claim and your deadlines. Colorado law controls Colorado projects.

Colorado’s penalties for overstated liens
- Excessive lien. If you file a lien for more than is due, without a reasonable possibility it is due and knowing it is more than is due, you forfeit the lien and owe the owner’s costs and all attorney’s fees (C.R.S. § 38-22-128).
- Groundless or false documents. Recording a document against title knowing or having reason to know it is groundless or contains a material misstatement can make you liable for at least $1,000 or actual damages, whichever is greater, plus reasonable attorney fees (C.R.S. § 38-35-109(3)).
- Spurious lien show-cause. An owner can ask a court to order the lien claimant to appear 14 to 21 days after service. If the court finds the lien spurious, it releases it and enters judgment for the owner’s costs, including reasonable attorney fees (C.R.S. § 38-35-204).

How to keep the number defensible
- Tie every dollar to the contract, a signed change order, or a documented field directive.
- Subtract payments, credits, and backcharges you agree with.
- Flag disputed extras separately with your attorney instead of folding them in.
- Keep invoices, pay apps, and photos that back the math.
Why clean claims get funded
A funder looks at whether the amount holds up. A lien that invites a fee-shifting counterclaim is a weaker claim. See also filed a lien and still not paid.
How Darkwell helps
Legal costs are often what stops a good claim. Darkwell helps carry them. On a Colorado lien claim, that can mean funding the foreclosure suit once your attorney confirms the amount.
- We help carry the cost. Darkwell funding helps pay for the case, so your operating cash stays in your business.
- We bring attorneys we know. Darkwell has a network of attorneys we know. They help keep costs down while still pursuing the claim. The claim moves forward with an attorney from our network, or your current attorney where it fits.
- Your attorney handles the law. We don’t run your case or choose your legal strategy. Your attorney does that.
- You make a clear decision. The goal is to take the stress out of the fight and make the smart financial decision about your claim.
What to send for a claim review
- Contract or subcontract, and change orders
- Invoices, pay applications, and payment history
- Job address and the owner, GC, or customer name
- Photos, daily logs, and delivery tickets
- Any notices, lien filings, or bond information
- Your attorney’s contact, if you have one
How we get paid

Common questions
Does a math mistake make my lien excessive? Section 38-22-128 targets amounts claimed knowingly and without a reasonable possibility they are due. Your attorney evaluates honest disputes.
What happens if a court finds my lien spurious? Under § 38-35-204, the court releases the lien and enters judgment for the owner’s costs, including reasonable attorney fees.
Does Darkwell control my case? No. Your attorney handles the case and the legal strategy. Darkwell provides funding.
